1. About these terms

These Terms of Service govern access to and use of https://maisalo.com and its related online features (the “Website”). The Website is operated by MAI SALO RETAIL, S.L., trading as Mai Salo. References to “Mai Salo”, “we”, “us” and “our” mean MAI SALO RETAIL, S.L.

By accessing or using the Website, you agree to these Terms of Service. If you do not agree, you should not use the Website.

These terms concern use of the Website. Purchases are also governed by our Terms of Sale, Refund Policy, Shipping Policy and the information presented before you place an order. If there is a conflict concerning a purchase, the Terms of Sale and mandatory consumer law prevail. Nothing in these terms limits rights that cannot lawfully be excluded.

2. Access and accounts

You may use the Website only where permitted by law. To create an account or place an order, you must have the legal capacity to enter into the relevant agreement. Minors may use the Website only with the involvement and permission of a parent or legal guardian where permitted by applicable law.

Information you provide must be accurate, current and complete. You are responsible for keeping your account credentials confidential and for notifying us promptly at hello@maisalo.com if you suspect unauthorized access. Accounts may not be sold, transferred or used to impersonate another person.

3. Website and product information

We take reasonable care to present Website and product information accurately. Product colours and appearance may vary slightly depending on lighting, photography, screen settings and natural variations in materials. These variations do not limit the legal requirement that goods conform to the contract.

We may update Website content, future prices, descriptions and product availability. Changes do not retroactively alter an order already accepted, except where permitted by applicable law or agreed with you. Order formation, pricing, payment, delivery and cancellation are addressed in the Terms of Sale.

4. Acceptable use

You must use the Website lawfully and in good faith. You must not:

  • use the Website for unlawful, fraudulent or deceptive purposes;
  • interfere with the Website’s operation, security or other users;
  • introduce malware or attempt unauthorized access;
  • infringe intellectual property, privacy or other rights;

  • use automated systems in a way that overloads the Website or circumvents access controls or technical restrictions, except where permitted by law or expressly authorized by us.

We may use proportionate technical measures to prevent misuse and protect the Website and its users.

Unless otherwise stated, the Website and its content—including its design, text, photographs, graphics, logos, trademarks, product names, video, audio and software—are owned by or licensed to MAI SALO RETAIL, S.L. and are protected by applicable intellectual and industrial property laws.

You may view and use the Website for personal, non-commercial purposes. You must not reproduce, distribute, modify, publicly communicate or commercially exploit protected content without permission from the relevant rights holder, except where such use is permitted by applicable law.

6. Third-party services and Shopify

The Website may contain links to, or features provided by, third parties. Their services may be governed by separate terms and privacy notices. We do not control third-party websites and are not responsible for their content or availability, except where liability cannot lawfully be excluded.

Mai Salo is powered by Shopify, which provides the ecommerce infrastructure used by the Website. Sales and purchases made through the Website are made directly with MAI SALO RETAIL, S.L.; Shopify is not the seller and is not responsible for fulfilling Mai Salo orders. To the extent permitted by law, Shopify and its affiliates are released from claims arising solely from sales between you and MAI SALO RETAIL, S.L. This does not limit your mandatory rights against us or any obligations Shopify may independently have under applicable law.

7. Privacy

Our processing of personal information is described in our Privacy Policy. Shopify and other service providers may also process personal information as described there. Your use of the Website remains subject to applicable privacy and cookie choices.

8. Reviews, feedback and other submissions

If you voluntarily submit a review, image, comment, suggestion or other content, you retain ownership of your content and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt and communicate it as reasonably necessary to operate, improve and promote Mai Salo and the Website.

You must have the rights needed to submit that content, and it must not be unlawful, misleading, abusive or infringe another person’s rights. We may moderate or remove content where reasonably necessary to enforce these terms or comply with law. This section does not grant us rights over personal information beyond those described in the Privacy Policy.

9. Availability and security

We use reasonable technical and organizational measures to operate the Website securely and reliably. We may update, maintain, restrict or temporarily suspend parts of the Website for security, maintenance, legal or operational reasons. Where reasonably possible, we will minimize disruption and provide notice of material interruptions.

We cannot guarantee uninterrupted or error-free access, particularly where disruption is caused by third-party services or circumstances beyond our reasonable control. This does not limit obligations or consumer rights that cannot lawfully be excluded.

10. Suspension and termination

We may restrict or suspend access to an account where reasonably necessary because of a serious or repeated breach of these terms, suspected fraud, a security risk or a legal requirement. Measures will be proportionate, and we will provide notice where reasonably possible and lawful.

Suspension or termination of Website access does not cancel an accepted order or affect rights and obligations that arose beforehand, including statutory consumer rights.

11. Liability

Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, lack of conformity of goods, or any other liability or consumer right that cannot lawfully be excluded or limited.

For consumers, we are responsible in accordance with applicable law. To the maximum extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the relevant agreement was made or that arise solely from third-party services or circumstances beyond our reasonable control. This does not alter our obligations as the seller under the Terms of Sale or applicable consumer law.

12. Changes to these terms

We may update these terms to reflect changes in law, the Website or our operations. The current version and its update date will be posted here. Material changes will be communicated where required by law.

Changes apply prospectively and do not retroactively alter an order already accepted or rights that have already arisen.

13. Applicable law and jurisdiction

These terms are governed by Spanish law, without depriving consumers of mandatory protection provided by the law of their country of residence. Any dispute will be submitted to the courts determined by applicable mandatory law, including the courts of the consumer’s domicile where required.

14. General provisions

If any part of these terms is found invalid or unenforceable, the remaining provisions continue to apply where legally possible. A failure to enforce a provision is not a waiver of the right to enforce it later.

We may transfer our rights or obligations only where permitted by law and where doing so does not reduce your rights. We will provide notice where required.
